Military court takes over child solicitation case

The Air Force has taken over prosecution in the child solicitation case against a Cannon master sergeant, according to Cannon officials.

Master Sgt. Mark Swartz, a non-commissioned officer with Cannon’s security forces, is facing charges in federal military court.

Officials with Cannon’s judge advocate general’s office said evidence in the case is currently being reviewed by the commander to determine whether charges should be recommended for trial. It is a formal step that precedes the charges being brought for prosecution.

Swartz’ attorney Capt. Christopher Jones said it was too early in the case for him to comment.

Swartz, 43, was arrested in August 2006 by civilian authorities and charged in district court with attempting to arrange for sexual relations with a New Mexico state police officer posing as an 11-year-old girl on the Internet.

Police have said the months-long investigation involved state, county, city, and military law enforcement.

District Attorney Matt Chandler said he made the decision to dismiss charges in civilian court and allow the military to take jurisdiction. He said his office will continue to watch the case and has the right to refile charges if they choose to do so.

“After meeting with legal council for the U.S. Air Force, we felt that the case would be best handled through the U.S. Air Force and the federal system,” he said. “We all believe that they can handle this and give us the best opportunity for justice and a good resolution.”
