Attorneys still reviewing shooting investigation

New Mexico State Police officials have forwarded results of their investigation of the Oct. 8 officer-involved deadly shooting in Clovis for review by a panel of three district attorneys. But the decision as to whether criminal charges should be pursued in the case could still take months.

District Attorney Andrea Reeb, who is not on that panel, said Thursday the case of Clovis Police Officer Brent Aguilar’s fatal shooting of Aaron Chavez south of the Prince Street overpass was turned over “a couple weeks ago” to the Administrative Office of District Attorneys, who will evaluate it.

“It could take a couple months, and there could also be some additional holdups, because we’re still waiting on ballistics,” she said.

Although a report has been given to AODA, she said it “can’t be turned over (to the public) as it’s pending investigation.”

Reeb referred additional questions on that process to 11th Judicial District Attorney Rick Tedrow, who is not the panel but is affiliated with the AODA. Tedrow did not return messages Thursday and Friday asking for updates on the case.

An NMSP spokesman asked The News to make another formal records request for the report. The News also made a formal request for the report a few days after the incident.

Aguilar returned to duty about a week after the incident.
