Muleshoe High band director charged with enticing minor

LUBBOCK — The Muleshoe High School Band director will remain held at the Lubbock County Detention Center until a federal judge decides whether he is a flight risk or a danger to the community.

William Alan Shelly, 61, of Portales, on Thursday appeared with his lawyer, Lubbock attorney Keltin Lee VonGonten, before U.S. Magistrate Judge D. Gordon Bryant for an initial appearance hearing.

Shelly, who has been held at the Lubbock jail since Monday, was indicted Wednesday by a federal grand jury on a count of enticement and attempted enticement of a minor.

Prosecutor Sean Long read out the indictment that stated Shelly was accused of enticing or attempting to entice a Muleshoe ISD student to engage in sexual activity from in or about January.

Enticement of a minor carries a punishment of 10 years to life in prison.

Bryant informed Shelly that the U.S. Attorney's Office filed a motion to detain him while his case moves forward. The judge set a hearing for Wednesday, when prosecutors will make their argument that the court could not impose conditions that would guarantee Shelly's appearance at future court dates or the safety of the community.

Muleshoe ISD Superintendent R.L. Richards said Shelly remains on paid administrative leave until the school board decides on his employment status, which he said may happen soon.
